The Grounds for this Indictment are: Officer 306 Shields was patrolling at the intersection of Elgin and Vespucci when a car drifted around the corner and began weaving back and forth on the road. Officer 306 Shields activated the cruiser's lights and sirens to initiate a traffic stop. The driver initially continued to weave behind Officer 306 Shields but eventually evened out and pulled over on Elgin Ave above Del Perro Freeway.
Approaching the vehicle, Officer 306 Shields requested the driver's identification and registration. The driver provided an ID identifying himself as "Murky Bazano" and claimed to have recently purchased the car from PDM. When questioned about his drifting behavior, Mr. Bazano stated that he was simply testing out the car's capabilities.
Officer 306 Shields returned to his motorcycle unit and ran the license plate. Inquiring over the dispatch, Officer 306 Shields checked if Judge Rajesh Gupta had reported his car stolen. Officer 214 Judge confirmed that the Judge had reported his car being at City Hall and disappearing mysteriously.
As Officer 306 Shields was seeking confirmation, the driver suddenly exited the vehicle and opened fire on Officer 306 Shields. Responding to the threat, Officer 306 Shields returned fire, causing the suspect to fall to the ground and require medical attention.
Officer 306 Shields immediately alerted other units over the radio, reporting shots fired and a downed suspect, and requested backup. Officers 214 Judge, 502 Rodger, and 512 Mckinstry arrived at the scene, providing medical assistance to the suspect and securing the area. 325 Lemly treated the suspect on-site, stabilizing him before transportation to Eclipse Medical for further evaluation and treatment.
Mr. Bazano was taken into police custody and expressed surprise that he was being arrested. He made an inappropriate comment about shooting Officer 306 Shields multiple times and questioned why he was facing charges. Mr. Bazano was then transported to MRPD for processing, where he was read his Miranda rights during the journey. At MRPD, he underwent fingerprinting and had his mugshot taken.
While in the holding cells, Mr. Bazano claimed that Judge Gupta allowed him to drive the car and that they were friends. Officer 306 Shields contacted Judge Gupta to verify the car's ownership and whether it was stolen. The Judge confirmed that his car was at City Hall and disappeared without his permission.
Officer 306 Shields informed Mr. Bazano of the charges and fine against him. Mr. Bazano pleaded not guilty to the charges. During his time in custody, he unexpectedly reached through the bars and assaulted Officer 214 Judge. As a result, Mr. Bazano was transferred to the custody of the Department of Corrections (DOC) and subsequently transported to Boilingbroke Penitentiary.
Mr. Bazano was not fined but was sentenced to 105 months in prison for his actions.
