The Grounds for this Indictment are: While I was on state police duty I noticed a 10-31, a crime in progress, happening right next to the lighthouse. I responded to the call and when I arrived I didn't really notice a vehicle at the scene. because i was on a drug run yesterday I decided to open my camera and zoom in on the islands close by. I found three individuals on the island and I closely started to see what they were doing and realize that they were cultivating weed. I relayed this information to radio and requested backup. We equipped on scuba gear and respirators and swam to the island. As soon as we arrived on island all three suspects started running away. Multiple officers spread out to capture all three. All three suspects left the island except for one, Tommy Bazono, who was successfully caught on the island and had most of the weed on him. The suspects started swimming towards the mainland where one of them successfully ran away but Boyd Allison continued and was later picked up by Theo Thomsen in a Sultan. Officers began chasing the sultan which lasted roughly 10 to 15 minutes where it ended under power Street near the stairwell. Both Boyd Allison and Theo Thomsen got out of the vehicle and started running on foot where they were then later caught, placed in cuffs, and were taken to Eclipse Medical. They were then taken to MRPD processing. While talking in the cells, Theo said that he was not part of the cultivating he was just there to pick them up. Nonetheless, he was charged with a HUT because he helped in an Escape of an individual that was part of a cultivating scene and in order for him not to move possible illegal Contraband within the two individuals houses.

The initial filing will come later, but the defendant is to be immediately released from Bolingbroke penitentiary. It is unacceptable for a individual to be held on HUT for almost the maximum amount of time to then have the charges lowered to misdemeanors. In the future I recommend the district attorney's office push HUT charges to the front of almost all other cases due to the circumstances surrounding them.

I, Garry Shoeman, the presiding Judge in this matter, hereby announce that the Court will grant a period of forty-eight (48) hours for the appointment of legal representation.

Once legal representation has been assigned to both parties (The state and the defense), we will promptly commence the discovery phase. The discovery period will remain open for twenty-four (24) hours preceding the scheduled Trial Date. Following a seventy-two-hour (72) window for discovery, a scheduler will be promptly dispatched.

Failure of the State to respond within the specified timeframe will result in the Dismissal of this case with Prejudice.

In response to the Defendant's statement, "I don't wake up anymore, go ahead and dismiss," it is evident that the Defendant is no longer willing to pursue a defense. Consequently, based on this response, I, Judge Garry Shoeman, as the presiding Judge in this matter, will issue a Default Judgment in this case.

The grounds for this Default Judgment are rooted in the Defendant's explicit declaration of their unwillingness to participate in the legal proceedings or offer a defense against the charges brought against them.

Therefore, I, Judge Garry Shoeman, find the Defendant guilty of the following charged crimes:

1. Count G.M. 1021 - Fleeing/Eluding Law Enforcement on Foot.
2. Count G.M. 1003 - Resisting Arrest.

For the initial charges, the Court sentences the Defendant to serve a period of 10 months in prison along with a $450 fine.

However, due to the Defendant's blatant disregard for the Court's authority and wasting the Court's time with their nonchalant response to the importance of the justice system in this state, I find it necessary to impose an additional charge of Contempt of Court.

I am firm and uncompromising when it comes to upholding the principles of justice and maintaining order in my courtroom, I must emphasize the importance of treating Court proceedings with utmost seriousness and respect. This behavior of nonchalance will not be tolerated. the time and fine will be 35 months and 1000 dollar fine.

Therefore, the Court hereby imposes the aforementioned sentence for the initial charges along with the additional charge of Contempt of Court.
Defendant, take this as a lesson that the Court will not hesitate to impose harsher penalties when faced with such dismissive and disrespectful attitudes.

The total time and fine will be 45 months, with a 1450 dollar fine.

You have 24 hours to turn yourself into a law enforcement officer or a warrant will be issued for your arrest.

This matter is now closed.
